TrademarkRegistration&IPProtection
New Zealand trademark registration, intellectual property protection, licensing agreements, and brand asset management.
How we can help
Your brand is one of your most valuable business assets. Registering a trademark in New Zealand gives you exclusive legal rights to use your brand name, logo, or slogan in connection with your goods or services - and the ability to take action against anyone who infringes those rights. Indus Legal advises Auckland businesses on trademark registration with the Intellectual Property Office of New Zealand (IPONZ), as well as broader intellectual property protection strategies to safeguard your competitive advantage.
We guide clients through the entire trademark registration process under the Trade Marks Act 2002 - from conducting preliminary searches to confirm availability, through to preparing and filing the application, responding to any examination objections, and managing the registration through to grant. We also advise on the classification of goods and services, the protection of overseas trademarks in New Zealand, and the enforcement of trademark rights against infringers.
Beyond trademarks, our intellectual property team assists with licensing agreements, confidentiality and non-disclosure agreements, copyright matters, and the IP components of business sales and commercial transactions. For businesses in South Auckland, Botany, and across New Zealand, protecting your intellectual property is essential to preserving the value of what you have built.

Frequently asked questions
How long does it take to register a trademark in New Zealand?
+
If the application proceeds smoothly without objections or oppositions, a New Zealand trademark can be registered within approximately four to six months from filing. After IPONZ examines the application and accepts it, it is advertised for a three-month opposition period. If no opposition is filed, the trademark proceeds to registration. Indus Legal manages the entire process and keeps you informed at each stage.
What can I register as a trademark in New Zealand?
+
Under the Trade Marks Act 2002, you can register words, logos, slogans, shapes, colours, sounds, and even scents as trademarks, provided they are distinctive and capable of distinguishing your goods or services from those of others. A trademark cannot be registered if it is too descriptive, generic, or likely to be confused with an existing registered mark. We advise on whether your proposed mark is registrable and, if necessary, help you develop a stronger, more distinctive brand identity.
Do I need to register a trademark, or is using it enough?
+
While you do acquire some common law rights simply by using a brand name in trade, these rights are limited and difficult to enforce. Registration gives you a statutory presumption of ownership and exclusive rights nationwide from the date of application. It also makes it significantly easier and less expensive to take legal action against anyone who copies or imitates your brand. For businesses operating in Auckland or across New Zealand, registration is a cost-effective way to protect a valuable business asset.
